cortejando os piratas

sabe o que eu mais gosto no caso pirate bay? é que quando você acha que o lado negro da força ganhou, a sorte dos piratas muda. desta vez uma corte sueca se recusa a mandar cortar as atividades do novo torrent tracker do site! não é incrível?

nem tanto, quando lembramos que a suécia tem um partido pirata, expressivo a ponto de faturar uma cadeira no parlamento europeu. é um país dividido.

outro juiz podre no caso pirate bay

talvez os quatro sócios do caso pirate bay, condenados por um juiz com conflito de interesses por infringirem direitos autorais ao permitir a troca de arquivos mp3 no site, tenham uma chance mais justa na apelação: ontem um dos três juizes escalados para ouvi-los mês que vem foi afastado do caso.

the swedish judge in question, fredrik niemela, owns an unstated number of stock options in the music streaming service, spotify, which has content deals with members of the recording industry association of america.

curiosamente, foram os próprios porcos da indústria fonográfica que pediram o afastamento. seu jogo corrupto ia ficar muito na cara se mais um juiz com rabo preso se envolvesse no caso, não é mesmo?

a derrota dos piratas

com as mãos atadas pela condenação de abril passado, que não só prevê o pagamento de eu$3 milhões como também a prisão de seus quatro fundadores, o the pirate bay resolveu se sujeitar à compra pela global gaming factory x ab.

the myth is over that the pirate bay would carry on as an underground site, even if its co-founders lost their appeals and went to prison for a year. (...) "the pirate bay is a site that is among the top 100 most visited internet sites in the world. however, in order to live on, the pirate bay requires a new business model, which satisfies the requirements and needs of all parties, content providers, broadband operators, end users, and the judiciary," hans pandeya, global gaming's chief executive, said in astatement. "content creators and providers need to control their content and get paid for it."

mais um baluarte da resistência vira pastiche. a comoção é geral:

mesmo condenado, o the pirate bay segue rindo da cara das grandes corporações através de sisteminhas cada vez mais engenhosos. a última novidade é o ainda muito rudimentar the video bay: serviço de compartilhamento de vídeos que, ao contrário do youtube, não vai permitir que filminhos sejam retirados do ar por conta de alegações de direitos autorais.

partido pirata arremata cadeira no parlamento europeu

outra coisa que costuma estreitar meus laços com a itália são as correspondências que recebo do consulado. em geral tem a ver com atualização de dados cadastrais, por causa da cidadania; mas da última vez, há duas semanas, foi a papelada relativa à eleição do parlamento europeu.

se (quase) nunca compareço às urnas no brasil, que dirá preencher uma cédula eleitoral em italiano e enviar de volta.

seria diferente se eu descendesse de suecos: acabo de saber que o partido pirata da suécia acaba de conseguir uma cadeira no parlamento europeu:

the party, formed to protest copyright law, took 7.1 percent of votes in sweden and one of that country's 18 seats in the european parliament. the party stands for radical reform of copyright legislation, abolition of the patent system and guaranteed online-privacy rights.


the party gained a renewed focus in sweden after the four founders of the pirate bay, the world's most notorious bittorrent tracker, were convicted of copyright infringement and ordered jailed for a year and fined millions.

activist christian engström, who will assume the pirate party seat this fall, told wired.com in a recent interview that copyright laws are becoming an affront to privacy.

o rabo preso do juiz do caso pirate bay

the pirate bay may have grounds for a retrial. it turns out that the judge in the case, tomas norstrom, might have a slight conflict of interest. he's a member of the swedish copyright association and sits on the board of swedish association for the protection of industrial property.

peter althin, the lawyer for the pirate bay cofounder peter sunde, said he's asking the swedish appeals court to consider ordering a retrial based on the judge's possible bias, the bbc reports. "the judge in one of sweden's most high profile case ever is also a member of an interest organisation for one side and associates with the prosecution trial lawyers in his free time? that is inexcusable corruption.

the pirate bay: desfecho aviltante

muitíssimo me fere o resultado da grande batalha jurídica entre o the pirate bay e as gigantes da indústria fonográfica:

a court in sweden has jailed four men behind the pirate bay (tpb), the world's most high-profile file-sharing website, in a landmark case. frederik neij, gottfrid svartholm warg, carl lundstrom and peter sunde were found guilty of breaking copyright law and were sentenced to a year in jail. they were also ordered to pay $4.5m (£3m) in damages.


record companies welcomed the verdict but the men are to appeal and sunde said they would refuse to pay the fine. speaking at an online press conference, he described the verdict as "bizarre".

it's serious to actually be found guilty and get jail time. it's really serious. and that's a bit weird, sunde said. it's so bizarre that we were convicted at all and it's even more bizarre that we were [convicted] as a team. the court said we were organised. i can't get gottfrid out of bed in the morning. if you're going to convict us, convict us of disorganised crime. we can't pay and we wouldn't pay. even if i had the money i would rather burn everything i owned, and i wouldn't even give them the ashes.

the damages were awarded to a number of entertainment companies, including warner bros, sony music entertainment, emi and columbia pictures. however, the total awarded fell short of the $17.5m in damages and interest the firms were seeking.


speaking to the bbc, the chairman of industry body the international federation of the phonographic industry (ifpi) john kennedy said the verdict sent out a clear message. these guys weren't making a principled stand, they were out to line their own pockets. there was nothing meritorious about their behaviour, it was reprehensible.

the pirate bay did immense harm and the damages awarded doesn't even get close to compensation, but we never claimed it did. there has been a perception that piracy is ok and that the music industry should just have to accept it. this verdict will change that, he said.

the four men denied the charges throughout the trial, saying that because they did not actually host any files, they were not doing anything wrong. speaking on swedish radio, assistant judge klarius explained how the court reached its findings. the court first tried whether there was any question of breach of copyright by the file-sharing application and that has been proved, that the offence was committed.

the court then moved on to look at those who acted as a team to operate the pirate bay file-sharing service, and the court found that they knew that material which was protected by copyright but continued to operate the service, he said.

a lawyer for carl lundstrom, per samuelson, told journalists he was shocked by the guilty verdict and the severity of the sentence. that's outrageous, in my point of view. of course we will appeal, he was quoted as saying by reuters news agency. this is the first word, not the last. the last word will be ours.

political issue

rickard falkvinge, leader of the pirate party - which is trying to reform laws around copyright and patents in the digital age - told the bbc that the verdict was "a gross injustice". this wasn't a criminal trial, it was a political trial. it is just gross beyond description that you can jail four people for providing infrastructure. there is a lot of anger in sweden right now. file-sharing is an institution here and while i can't encourage people to break copyright law, i'm not following it and i don't agree with it. today's events make file-sharing a hot political issue and we're going to take this to the european parliament.


the pirate bay is the world's most high profile file-sharing website and was set up in 2003 by anti-copyright organisation piratbyran, but for the last five years it has been run by individuals. millions of files are exchanged using the service every day. no copyright content is hosted on the pirate bay's web servers; instead the site hosts "torrent" links to TV, film and music files held on its users' computers.

the pirate bay x gigantes da indústria fonográfica: fim do julgamento

se você não está por dentro do julgamento do pirate bay, com certeza está perdendo um verdadeiro show. o que era pra ser mais um tedioso processo envolvendo a indústria da música contra um site de torrents está virando um verdadeiro espetáculo à favor da livre troca de informações e assistido por milhares de pessoas no mundo todo - a maioria absoluta apoiando o pirate bay.


o principal motivo disso é a mobilização que os envolvidos com o pirate bay (gottfrid svartholm warg, peter sunde kolmisoppi, carl lundström e fredrik neij) estão fazendo nas redes sociais como o twitter e facebook, incluindo fãs transmitindo o julgamento pela internet com webcams caseiras, disponibilizando depoimentos em mp3, fazendo protestos na rua e muito mais. essa cobertura dos bastidores do julgamento recebeu o nome de spectrial. o site é processado pela international federation of the phonographic industry (ifpi) que representa em conjunto interesses das gigantes warner bros, mgm, emi, colombia pictures, 20th century fox, sony bmg e universal.

a mobilização pública a favor do pirate bay atingiu seu ápice com a criação do site http://filesharer.org/. sob o título "essa é a verdadeira cara de um criminoso", os visitantes publicam fotos de seus rostos declarando que "não são as pessoas por trás do pirate bay que trocam arquivos ilegais na web. somos nós, milhões de pessoas que usamos o site. eles estão atrás das pessoas erradas. nós não vamos desaparecer mesmo que o pb perca a causa, nem a tecnologia que nos permite compartilhar músicas e filmes que nós gostamos vai sumir". até agora, 2571 "criminosos" fizeram o upload de suas fotos no site.

todos contra fairey (eu a favor dele)

ainda não mencionei que, além de ser alvo de uma discussão acerca de plágio desencadeada pelo artista plástico mark vallen, nosso herói shepard fairey também está envolvido numa querela com a associated press (ap) por ter usado a imagem de obama para produzir o pôster-símbolo da campanha do agora presidente.

apesar da ap alegar violação de direitos autorais, manny garcia, o fotógrafo que capturou a imagem usada por fairey, não está nem aí pra história.

então, numa espirituosa reviravolta, fairey decidiu processar a ap primeiro. ele quer que um juiz federal declare que ele não fez nada de errado.

para tirar a história a limpo, o apresentador e comediante stephen colbert chamou um diretor de museu e um especialista em direitos autorais para dizer quem está certo. os últimos segundos do filminho esclarecem a pendenga de forma tão surpreendente.
